Terms of Service

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING SETWAR. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pixel Reef, LLC, a Florida limited liability company ("Pixel Reef," "Company," "we," "us," or "our"), governing your access to and use of SetWar, including our website at setwar.com, applications, AI content generation services, and all related features and functionality (collectively, the "Service").

1. Acceptance and Modification of Terms

1.1 Agreement Formation

By creating an account, accessing the Service, or using any features of SetWar, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, and Acceptable Use Policy, all of which are incorporated herein by reference and collectively form the complete agreement between you and Pixel Reef.

1.2 Modifications

We reserve the right to modify these Terms at any time in our sole discretion. Material changes will be communicated through the Service or via email at least 30 days before taking effect. Your continued use of the Service after modifications constitute acceptance of the updated Terms. If you disagree with modifications, you must discontinue use of the Service.

1.3 Eligibility Requirements

You must be at least 13 years old to use the Service. If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you must be at least 16 years old. If you are under 18, you represent that you have parental or guardian consent to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms and that all information provided is accurate and complete.

2. Account Registration and Security

2.1 Account Creation

To access certain features, you must create an account using our secure authentication system or approved third-party providers (such as Google OAuth). You agree to provide accurate, current, and complete information during registration and to promptly update such information to maintain its accuracy.

2.2 Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether authorized or unauthorized. You agree to immediately notify us at security@pixelreef.org of any suspected unauthorized use of your account or any other security breach.

2.3 Account Restrictions

You may not: (a) create multiple accounts to circumvent usage limitations; (b) share account credentials with third parties; (c) use automated systems to create accounts; or (d) impersonate another person or entity. Violation of these restrictions may result in immediate account termination.

3. Service Description and Availability

3.1 AI Content Generation Platform

SetWar provides an AI-powered platform for generating tabletop role-playing game content, including but not limited to adventures, encounters, NPCs, locations, factions, items, and campaign materials. The Service utilizes advanced artificial intelligence models to create unique content based on user prompts and preferences.

3.2 Service Availability and Modifications

While we strive to provide reliable access, the Service is provided "as available" and may experience interruptions due to maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including but not limited to features, functionality, or availability.

3.3 Beta Features

We may offer experimental or beta features that are clearly marked as such. These features are provided "as is" without warranties and may be modified or discontinued without notice. Your use of beta features is at your own risk.

4. Subscription Plans and Billing

4.1 Free Plan

All users receive access to our Free Plan, which includes one (1) AI content generation per calendar day. The daily limit resets at 00:00 UTC. Free Plan users may also access limited features and content storage. No payment information is required for the Free Plan.

4.2 SetWar Pro Subscription

SetWar Pro is our premium subscription service currently priced at $9.99 USD per month (subject to change with 30 days' notice). Pro subscribers receive:

  • Unlimited AI content generations
  • Advanced customization and configuration options
  • Priority processing and enhanced performance
  • Extended content storage and organization tools
  • Campaign continuity and world-building features
  • Export capabilities (PDF, text, JSON)
  • Early access to new features and beta functionality

4.3 Payment Processing and Authorization

All payments are processed securely through Stripe, Inc. By subscribing to SetWar Pro, you authorize us to charge your designated payment method on a recurring basis until you cancel. You are responsible for providing accurate billing information and maintaining valid payment methods. Failed payments may result in service suspension.

4.4 Automatic Renewal and Cancellation

Subscriptions automatically renew each month on the anniversary of your subscription date unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support@pixelreef.org. Cancellation takes effect at the end of your current billing period, and you retain Pro access until that time.

4.5 Refund Policy

Refunds are generally not provided for partial subscription periods. However, we may, in our sole discretion, issue pro-rated refunds if you cancel within seven (7) days of your most recent charge and have not extensively used Pro features during that period. Refund requests must be submitted to billing@pixelreef.org with justification.

4.6 Price Changes

We reserve the right to modify subscription pricing with at least 30 days' advance notice. Price changes will not affect your current billing period but will apply to subsequent renewals. You may cancel before the price change takes effect if you do not agree to the new pricing.

5. Intellectual Property Rights

5.1 Pixel Reef Intellectual Property

The Service, including its software, algorithms, user interface, design, branding, trademarks, and all proprietary content, is owned by Pixel Reef and protected by United States and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

5.2 User Input License

You retain ownership of prompts, inputs, and preferences you provide to the Service ("User Input"). By submitting User Input, you grant Pixel Reef a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, store, and analyze such content solely for the purposes of providing the Service, improving our AI models, and developing new features. This license survives termination of your account.

5.3 AI-Generated Content Ownership

Subject to these Terms and applicable law, you own the AI-generated content created through your use of the Service ("Generated Content"). You may use Generated Content for personal, educational, and commercial purposes, provided such use complies with these Terms, our Acceptable Use Policy, and applicable laws. Generated Content may not be unique, and similar content may be generated for other users.

5.4 Content Representations and Warranties

You represent and warrant that your User Input: (a) does not infringe any third-party intellectual property rights; (b) does not violate any applicable laws; (c) does not contain harmful, offensive, or inappropriate material; and (d) is accurate and complete. You agree to indemnify Pixel Reef for any claims arising from your User Input.

5.5 Feedback and Suggestions

Any feedback, suggestions, ideas, or improvements you provide regarding the Service ("Feedback") may be used by Pixel Reef without restriction or compensation. You hereby assign all rights, title, and interest in Feedback to Pixel Reef and agree to execute any documents necessary to effectuate such assignment.

6. Acceptable Use and Prohibited Conduct

6.1 Compliance with Policies

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree to use the Service only for lawful purposes and in accordance with all applicable laws, regulations, and these Terms.

6.2 Prohibited Activities

You agree not to: (a) use the Service to generate illegal, harmful, or inappropriate content; (b) attempt to reverse engineer, decompile, or extract the Service's algorithms; (c) use automated systems to access the Service beyond intended usage; (d) interfere with or disrupt the Service's operation; (e) violate any applicable laws or regulations; or (f) infringe third-party intellectual property rights.

6.3 Enforcement

We reserve the right to investigate suspected violations and take appropriate action, including content removal, account suspension, or termination. We may cooperate with law enforcement and provide information as required by legal process.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, describes how we collect, use, store, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy and agree that we may process your information in accordance with applicable privacy laws.

8. Disclaimers and Limitations of Liability

8.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.2 AI Content Disclaimers

AI-generated content may contain errors, inaccuracies, biases, or inappropriate material. We do not warrant the accuracy, completeness, reliability, or suitability of any Generated Content. You are solely responsible for reviewing, verifying, and using Generated Content appropriately. Generated Content should not be considered professional advice of any kind.

8.3 Third-Party Services

The Service may integrate with or reference third-party services, websites, or content. We are not responsible for the availability, accuracy, or content of such third-party services, and your use of them is at your own risk.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIXEL REEF, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

8.5 Maximum Liability Cap

Our total cumulative liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to us in the twelve (12) months preceding the claim; or (b) one hundred dollars ($100 USD).

8.6 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pixel Reef, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your User Input or use of Generated Content; (d) your violation of any third-party rights; or (e) any claim that your User Input caused damage to a third party.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting support@pixelreef.org or using account deletion features in the Service. Upon termination, your subscription will not renew, and you will lose access to Pro features at the end of your current billing period.

10.2 Termination by Us

We may suspend or terminate your account immediately, with or without notice, for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or illegal activity; (c) extended periods of inactivity; or (d) upon discontinuation of the Service. We are not liable for any consequences of termination.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data and Generated Content in accordance with our data retention policies. Sections that by their nature should survive termination will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@pixelreef.org with a detailed description of the dispute. We will attempt to resolve the matter within 60 days of receiving your notice.

11.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Orange County, Florida, or virtually by mutual agreement.

11.3 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND PIXEL REEF INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

11.4 Small Claims Exception

Either party may pursue claims in small claims court if the claim qualifies for such court's jurisdiction and proceeds only on an individual basis.

11.5 Injunctive Relief

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of such courts.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Pixel Reef regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects the original intent.

13.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or any rights hereunder without restriction, including in connection with a merger, acquisition, or sale of assets.

13.5 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or internet service provider failures.

13.6 Notices

Legal notices will be sent to the email address associated with your account or posted on the Service. You are responsible for keeping your contact information current.
